A newly released document obtained via a Freedom of Information Act request confirms that the State Department ordered the Department of Homeland Security to spare members of the Muslim Brotherhood traveling to the US in 2012 a TSA pat down or any kind of secondary screening.The one page document (PDF), obtained by the Investigative Project on Terrorism, shows that members of a Muslim Brotherhood delegation traveling through Minneapolis Airport, New York’s John F. Bloggers have 1st Amendment 'protection' in defamation suits


In a decision released by the 9th Circuit Court Of Appeals:

The protections of the First Amendment do not turn on whether the defendant was a trained journalist, formally affiliated with traditional news entities, engaged in conflict-of-interest disclosure, went beyond just assembling others’ writings, or tried to get both sides of a story.
 
As the Supreme Court has accurately warned, a First Amendment distinction between the institutional press and other speakers is unworkable: “With the advent of the Internet and the decline of print and broadcast media . . . the line between the media and others who wish to comment on political and social issues becomes far more blurred.” Citizens United, 558 U.S. at 352. In defamation cases, the public-figure status of a plaintiff and the public importance of the statement at issue—not the identity of the speaker—provide the First Amendment touchstones…."

We therefore hold that the Gertz negligence requirement for private defamation actions is not limited to cases with institutional media defendants. Obsidian Finance Group LLC et al v. Crystal Cox (9th Cir. Jan. 17, 2014), pp. 11-12.

First Amendment To The United States Constitution

This is a fair and just ruling coming from one of, if not the most liberal appeals court in our country. Maybe the 6th Circuit Court Of Appeals is more liberal? At any rate, this ruling gives 1st Amendment protection to those NOT from the media. This means to the public and bloggers, writers,you and me. The mode of publication, paper, internet, blog, mass media was not a determining factor in this ruling. It was taken under consideration but this ruling gives the public and bloggers equal protection under the 1st amendment. While I want to feel 'secure' and safe with this ruling, I do not. My reasoning is simple. It is what this and past administrations have done to chip away at our freedom and liberty. The 1st Amendment is the cornerstone of our Constitution, just my opinion. Without it, what do we have? Do not take this the wrong way and I am not an expert on the Constitution or Constitutional law. I have read the Constitution, The Bill Of Rights, The Federalist Papers, and many books relating to our Constitution.

Eugene Volokh is the attorney who represented the plaintiff, Crystal Cox in the case that was appealed to the 9th Circuit Court Of Appeals. If you have the time, use the links I have shared at the top of the post. It is very interesting reading and Mr. Volokh has done an excellent job. Still, the times being what they are, the arming of our Law enforcement agencies with massive and heavy weapons, the way many (not all) LEO and government agents dismiss, run over our 1st Amendment rights every day is of grave concern to me. It has been for years and I will be the first one to admit, I have a jaded, politically INCORRECT, very conservative view that has been formed over the course of my lifetime. The details of why and how I became very conservative are not important, at least not right now. Let me just say this: I am the conservative backlash to a very liberal upbringing.

The 9th is not the first Circuit Court Of Appeals to rule on this but it is very noteworthy that it came from the 9th, which is based in San Francisco. The 9th has typical upheld 1st Amendment individual, group, employee rights, especially when it has been in cases that were against corporations. Will the 9th pull reversal on this ruling? It has a track record of doing so and it would be a huge miscarriage of justice and a further erosion of our freedom if the 9th does reverse the ruling.

I see this as some good news and time will tell if this ruling stands up or not. The current regime has proven time after time they could care less about our rights, freedom or liberties, as the Founding Fathers set them forth in our Constitution.
None of us should be standing still or silent. 

Failure is not an option and be a renegade. A word I am am very fond of, renegade. This will be the subject of a post I am working on, RENEGADE. Are you one of the sheeple or 'Bad Company' as the current regime views us for exercising our Constitutional rights? Especially the 1st and 2nd Amendments. So be it, and I am at peace, in life or death.

Mohammad Rateb Alnabulsi is a Syrian sheikh who is touring the US and being co-sponsored by the Syrian American Council. Hussein Obamas pretty speeches about his crimes

Mark Levin was suggesting yesterday that conservatives in Congress need to get up and walk out when Obama gives his upcoming State of the Union address. “Give the people a choice, between liberty, and tyranny.” My thoughts were – that will never happen but I pray that it does. President Barack Obama gave a eulogy for the Fourth Amendment on Friday, and not even his fans are proclaiming victory. In this moment when Obama is actually doing one thing I agree with (talking to Iran), more and more people seem to be slowly, agonizingly slowly, finally, finally, finally, recognizing what a complete huckster he is when it comes to pretty speeches about his crimes.

Obama’s speech and new “policy directive” eliminate the Fourth Amendment. Massive bulk collection of everybody’s data will continue unconstitutionally, but Obama has expressed a certain vague desire to end it, sort of, except for the parts that are needed, but not to do so right away. The comparisons to the closure of the Guantanamo death camp began instantly.

Far from halting or apologizing for the abuses of the NSA, Obama defends them as necessitated by the danger of a new 911. While drones over Yemen and troops in Afghanistan and “special” forces in three-quarters of the world are widely understood to endanger us, and while alternatives that upheld the rule of law and made us safer would not require secrecy or human rights violations, Obama wants to continue the counterproductive and immoral militarism while holding off all blowback through the omniscience of Big Brother. Going where few Blacks are willing to go-Allen West has a message for WHITE Americans

Allen West is one man who I would seriously consider voting for for POTUS if I vote in the next election(s). This is a man who happens to a decent conservative and yes, he is Black. West has stepped off and away from the liberal plantation. He is a major problem for the progressive regressive, the far left liberals who are consumed by their own guilt because they are white, black, brown, you catch my drift here. These free thinkers cannot wrap their brainwashed minds around the fact that there ARE black conservatives. How dare these 'uncle tom's' exist. Yes, Allen West has been referred to as that, and if my memory is correct, as a 'house slave'.

Mr. West is a problem for Obama and Holder because he refuses to live in ghetto of liberal or black plantation politics. He has been criticized on PMSNBC, NPR, PBS, most of the MSM. Instead of realizing he represents Americans of all skin color, it is easier to brand him as a black traitor who should return to the plantation, bow down to Obama, the race baiters of the black grievance industry like Holder, Waters, Sharpton, Jackson, Ellison and so many others.

Allen west now has a blog and it is worth reading. In the past I have been critical of any politician who deserved criticism and there have been times I thought West could have stepped out and said more. He lost in Florida because of political gerrymandering with the votes to ensure he was ousted. Liberals will do anything to stay in power.

More racial protectionism from Holder, and a message to white Americans

When the concept of doing a website was presented to me, initially I scoffed thinking there wouldn’t be enough critical material daily to comment on — boy was I wrong. Every day I am amazed at the insanity I witness in our America and here is another example.

According to a report in The Hill, Attorney General Eric Holder is at it again with his racial preference policies,
Attorney General Eric Holder called upon the nation’s school districts Wednesday to rethink “zero tolerance” disciplinary policies that he said disproportionately punish minorities and push too many students into the justice system. Alarming numbers of young people are suspended, expelled or even arrested for relatively minor transgressions like school uniform violations, schoolyard fights or showing ‘disrespect’ by laughing in class,” Holder said during a speech in Baltimore.
What did his remarks really mean? They accompanied the release of new federal guidance from the departments of Justice and Education encouraging (i.e. threatening) schools to adopt disciplinary policies that are “fair, nondiscriminatory, and effective.” The guidance offers parameters for punishment as governed by federal civil rights protections, alternatives to exclusionary discipline and a comprehensive list of regulations on the books in every state.

So now the US Department of Justice under Eric Holder will use its power to enforce “civil rights protections” in school disciplinary actions. In fact, the DoJ and DoEd are putting schools on notice that they are prepared to use their authority to investigate the claims of racial disparity in the punishment of students. And of course the American Civil Liberties union (ACLU) is thrilled with this policy. The ACLU offered research showing that black students make up 36 percent of those expelled, though they represent only 15 percent of students.”

Not to be outdone by Holder in the “stuck on stupid” category, Education Secretary Arne Duncan stated, “Positive discipline policies” can actually foster safer school environments, without a heavy reliance on suspensions and expulsions. Schools also must understand their civil rights obligations and avoid unfair disciplinary practices.
I taught high school for one year in Deerfield Beach, Fla and in the end, it was such an enjoyable experience breaking up fights daily, that I decided to return to the combat zone of Afghanistan.

Teachers are already disrespected and attacked, not feared. There were students at Deerfield Beach who steered clear of the lunchroom for fear of being picked on or engaged in a fight. A kid was stabbed while I was on the faculty there. Yes, this violence on campus was perpetrated 8 out of 10 times by black students, male and female, but it had nothing to do with racial disparity. It had everything to do with a lack of discipline and control.

When a young man took a swing at me while I broke up a beat down that he and three others were giving a young man already on the ground, it had nothing to do with civil rights. It had everything to do with a criminal behavior which does not belong in a learning environment – and he was expelled. Now imagine under these new guidelines and rules, DoJ and DoEd would initiate an investigation.

Liberal progressives don’t want to tackle the problem they created, the decimation of the black family. Fifty years ago only six percent of births in America were out of wedlock Today the number is 72 percent in the black community. There was a time when “acting out” at school resulted in having to stay after school and worse, a call home to mom and dad — talk about a beat down.

Common core — now this — the progressive socialist dream of state-run education is coming to fruition. But what is even more heinous is the message being sent that race is an excuse for bad behavior in our kids, an acceptable excuse at that. It means the death spiral for education in the black community will increase as we overlook or reward the most abhorrent conduct.

Perhaps this is why Holder and Obama want Debo Adegbile as the Assistant Attorney General for the Civil Rights Division considering his defense of Black Panther and cop killer Mumia Abu-Jamal, when he was leader of the NAACP Legal Defense Fund. There is no doubt that someone skilled enough to defend Abu-Jamal would be perfect to institute this policy of racial protectionism of juvenile criminal behavior.

This is my clear and succinct message to white Americans. How long will it be before “you people” realize you have elevated someone to the office of president who abjectly despises you — not to mention his henchman Holder. Combined they are the most vile and disgusting racists — not you.

The Anti-Israel Movement in American Academia

I would like to add a postscript to the two articles I have put up in the past 24 hours about the appearance of Palestinian activist Omar Barghouti's appearance at the University of California at Riverside yesterday. This is the second time I have heard Barghouti speak. Today he is making two appearances at UCLA, both under the sponsorship of activist anti-Israel professors just as at Riverside.

I have written so many articles about the anti-Israel speakers who come to speak on university campuses, so I run the risk of repeating myself here. Omar Barghouti is a professional activist who travels the world giving lectures condemning Israel for being a "racist, apartheid state that is violating the human rights of Palestinians". As one of the other members of the audience so eloquently pointed out during the q and a yesterday, Barghouti is an expert in using emotionally-charged terms throughout his speech that are designed to inflame passions.

In addition, and arguably worse, Barghouti is sponsored from university to university by radical leftist faculty members who consider themselves to be fighters for justice and human rights, themselves two terms that have been hijacked by the left in academia. We heard it yesterday with English professor David Lloyd, the man who invited Barghouti to speak at UCR.

Justice. Human rights.

But when you hear Barghouti and his adoring sponsors in academia speak of the Israeli-Palestinian conflict, here are some things they don't talk about as they drone on about justice and human rights.

They will not talk about the 600-700,000 Jews who were driven out of Arab lands in 1948 as a result of the first Israeli-Arab war. They will only talk about the Palestinians who became refugees-many of whom left of their own accord upon the urging of the Arab armies who promised them  quick return once "Palestine" was conquered.

They will not dwell on the countless acts of Palestinian terrorism against innocent Israeli civilians. In my lifetime, I can recall the hijackings of airplanes by Palestinians, many of which resulted in loss of innocent life-of various nationalities. I also vividly recall the murder of the entire Israeli Olympic team in the 1972 Olympics by Palestinian terrorists. I also recall the Achille Lauro ship incident in the 1980s when Palestinian terrorists commandeered an Italian ship and murdered an American Jew named Leon Klinghofer, who was thrown overboard in his wheelchair. That has been followed by suicide bombings including buses in Israel blown up by bombers. To be sure, Barghouti said yesterday that he condemns killing of civilians though he thinks that attacks against Israeli soldiers are a form of "legitimate resistance" against what he calls "occupation".

In that vein, if you go to one of these university events on Israel, don't expect for anyone to mention the infamous massacre of the Fogel family a couple of years ago, in which Palestinians crept into a Jewish family's home in the settlement of Itamar and murdered practically the entire family by slitting their throats including a months-old baby asleep in a crib. That was greeted by dancing in the streets by the noble Palestinians.

Where were the great American academic human rights activists and fighters for "justice" when that happened? Forget about Palestinian activists like Barghouti. Where were the American academics who profess to be defenders of justice and human rights? I will tell you. They ignored it and ignore it to this day.

Let's take this a step further. Look at what is happening in Egypt to the Christians. Look at what is happening in Syria to the Christians while Sunnis fight against the forces of Assad and the Alawites (Shia). Look at what is happening in Sudan. Look at what is happening to gays and Baha'i in Iran. Look at what is happening to Christians and animists in Sudan. Look at what is happening to Christians in Pakistan. Look at what is happening to European Jews in the streets of European cities at the hands of Muslim immigrants. In fact, look at what is happening to religious minorities in virtually every Muslim nation on the planet. Persecution.

Where are the fighters for justice and human rights in American academia?

I will tell you. They are busy bringing in speakers like Omar Barghouti to condemn Israel for what they term "apartheid" against the Palestinian people. Never mind that Arabs, Muslims, and Christians, as well as gays, enjoy more freedom and human rights in Israel than in any of the surrounding countries.

It matters not. In fact, the Palestinian lobby, aided by American academics like Judith Butler, call the latter, "pink-washing" using the tolerance of homosexuality in Israel as unfair propaganda against its neighbors because in those lands, gays are likely to be killed.

"It's just not fair", say these learned academics who are teaching our children in our universities.

And what happens when someone is invited by a Jewish group on campus or the College Republicans to speak in favor of Israel? They are jeered, disrupted, and have to be escorted by security for their own safety. I was present at UC Irvine in 2010 when the Israeli ambassador to the UN, Michael Oren, came to speak. He was repeatedly disrupted by the Muslim Student Union, and it was only after they marched chanting out of the hall, that Oren was able to finish his speech. Yet, this English professor, David Lloyd, implied yesterday at UC Riverside that the Israeli side pretty much controls the dialogue. Not on a university campus, Dr Lloyd. He also said that when Oren came to UCI, nobody asked him to debate the Palestinian side. Considering that Oren was loudly disrupted and his own freedom of speech was attacked, I consider that a preposterous statement. The fact is that speakers like Barghouti, Amir Abdel Malik Ali, Jewish Voice for Peace, and others are a dime-a-dozen on any university campus. It is the pro-Israel people who are subject to intimidation within academia. This intimidation and yes-anti-Semitism could not exist without the collusion of these bozo professors and the cowardice of our university administrators.

Which leads me to my final point. No matter how much the Barghoutis of the world will deny it, the central point of the Israeli-Palestinian conflict is not about who owned what land back in 1948. It is about religion. The Arab states and the people who since the 1960s have called themselves "Palestinians", as if such a nation ever existed, will never except a Jewish state in the region. The Palestinian leadership both in the West Bank (Palestinian Authority) and Gaza are very clear that in a future Palestinian nation, there will be no Jews. The ultimate goal is the total elimination of the Jewish state of Israel and the elimination of Jews from the entire region.

If you are a college student attending these events, this is what they will never tell you because if they did, they know they would not gain the support of young American people. They are liars. They are propagandists. They could care less about human rights because they don't observe them in their own societies, and because if Israel is ever overrun, these same forces will slaughter every Jew they can get their hands on.

And shame on these bozo professors in our universities who use their positions in academia to indoctrinate our young people to support. Not only are they supporting the wrong side, they are enabling a resurgence in anti-Semitism.

The NEW and IMPROVED Fast and Furious

Was Operation Fast And Furious Really Part Of A Secret Deal Between The DEA And Mexico's Sinaloa Drug Cartel?

According to Mr. "left on politics and policy" Ungar, a "major Mexican newspaper" is saying that agreements were made "dating back to 2000 and continuing through 2012" between the U.S. DEA and "Mexico's largest drug trafficking gang, the Sinaloa Cartel."

...the deal involved the cartel providing information about rival Mexican drug gangs to the DEA in exchange for the U.S. government agreeing not to interfere with Sinaloa shipments into the United States and the dismissal of criminal charges against cartel participants.

As you read you will see the author insists on concentrating on the guns and bargains (and that's bad enough) the DEA made with the better of the bad guys and ignores the part of the bargain where "The Sinaloa Cartel was allegedly permitted to traffic massive amounts of drugs across the U.S. border from 2004 to 2009."

...would Americans feel better (about Operation Fast and Furious) if they knew that the weapons were actually being used as part of a strategy to take scores of drug traffickers belonging to Sinaloa's rival gangs off the playing field?


Indeed, if this is really a war, one might argue that this would be a pretty ingenious way to kill enemy soldiers.

This leads me to ask a provocative question--

If the "divide and conquer" strategy was being applied in Mexico as a part of the deal with the Sinaloa cartel--the same being based on what many would claim was a successful strategy used to scale back the drug trafficking originating in Colombia--was Fast and Furious the result of a U.S. government that couldn't shoot straight or a well organized effort to allow the Sinaloa crew to kill off thousands of rival drug traffickers to our mutual benefit?


It makes sense that it is to "our mutual benefit" to kill off rival drug dealers and all the while allowing "massive amounts of drugs across the U.S. border?" How about going in there and helping wipe out ALL dealers and NOT allow drugs across the border? Lordy I feel sorry for the Mexican people.

So just whose mutual benefit is this to the "left on politics and policy" genius speaking of? Obviously "our" government because it sure as hell is not to the benefit of our country for Americans to become addicted to drugs!

Or is it? 

Kool-aid or heroin - pick your poison here folks and as an added bargain, we and the media will blame all this on gun shows, gun dealers, and red necks!

The "provocative question" should have been WHO in our government is benefiting from "massive amounts of drugs" flooding our country!

Bearing True Faith and Allegiance

The above scene was painted by Norman Rockwell in late 1945, just after the end of World War Two. It depicts the homecoming of a U.S. Marine, who has returned from the Pacific with a captured Japanese flag and now commands the rapt attention of his listeners in a local garage.

The painting represents a time — within living memory, although just barely — when there was still a commonly understood ideal of what it meant to be an American. More honored in the breach than in the observance, perhaps, but nevertheless a generally accepted cultural norm of civic obligation.

The moment was before my time, but only by a decade or so. In my early childhood that view of America remained predominant. Those little boys in the picture were the young men of my time, and the returning servicemen were the fathers of kids like me. What Norman Rockwell presented in that painting and innumerable others was American normalcy, as we all understood it. Yet it might as well have been the time of the Peloponnesian War, for all the relevance it holds in what passes for today’s civic culture.
By the 1970s Norman Rockwell was discredited in the eyes of cultural arbiters in the media and academia. He was dismissed as a hackneyed, jingoistic nostalgia-peddler, an archaic throwback in a time when the most respected artists included Pablo Picasso and Jackson Pollock.

Centuries from now, when the foolish political and social fads of our time are long forgotten, Mr. Rockwell will be regarded with the respect he deserves. Like Rembrandt, he had an uncanny genius for depicting the human form and face in a way that conveyed a reality that the camera could not capture. He will be recognized as one of the great painters of our age — assuming, of course, that we have not by then become an American Emirate in the new Universal Caliphate, with all the graven images of our wretched jahiliyyah faithfully destroyed.

The cultural norms and ideals represented in Mr. Rockwell’s paintings were discarded along with his art. But this was true only within the lofty eyries of our cultural mandarins — he remains perennially popular among ordinary Americans, who revere his work as a reminder of what once was, but is now gone. The memory of the old culture still lingers in flyover country, even as it is deprecated, despised, and destroyed by the post-modern managers of the country formerly known as the United States of America.

For decades after most of the rest of the culture fell, the U.S. military remained a staunch bastion of the old ways. As the battering rams and siege engines of the long march broke down the walls of successive institutions — the media, academia, the public schools, commercial enterprises, the government — the military retained the spirit that was so lovingly chronicled by Norman Rockwell fifty years previously. The armed services functioned as a repository for our civic virtues.

All that has changed, thanks to deliberate, cynical policies implemented by the Obama administration. The top brass in all three services are now more concerned with putting women into combat and salving the feelings of their Muslim enemies than they are with their country’s ability to win a war.

The last walls of the citadel have been breached, and the barbarians are busily looting the storehouses and armories of the inner courtyard.

Article VI Section 3 of the United States Constitution requires the following of citizens who hold elected or appointed office:


The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
The wording of the required oath is specified under Title V § 3331 of the United States Code:
An individual, except the President, elected or appointed to an office of honor or profit in the civil service or uniformed services, shall take the following oath:
“I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
Every officer in the United States Military took that oath. The time will soon arrive when a serving officer will have to choose between keeping his oath and pursuing a comfortable career track in his chosen service.

I don’t envy the lot of a dedicated soldier right now. Maybe that’s why the attrition rate in the armed services is so high — honorable people are making the decision not to re-enlist rather than be a party to the unfolding travesty. Their collective departure leaves the field to ambitious cynics and opportunists.

Things were bad enough when the Pentagon decided that soldiers in Afghanistan had to treat the Koran with greater reverence than they treated the Bible. The situation deteriorated further when the brass ordered officers in the field to be more concerned with maintaining good community relations with the locals — some of whom were actively aiding the enemy — than with the lives of their own men.

Our government reached a new low, however, when it began to collaborate with Al Qaeda and its affiliates in Libya and Syria. The current president’s predecessor identified Al Qaeda as the enemy, but Barack Hussein Obama appears to have different ideas. Unfortunately, even if he doesn’t consider them to be our enemy, the mujahideen in the Maghreb have no doubt they are at war with us. They are manifestly enemies both foreign and domestic — the latter in a more subtle, suave, and dangerous form as infiltrators working for the Muslim Brotherhood. Aiding and abetting these enemies does not support and defend the Constitution of the United States.

Under such circumstances, how can a conscientious soldier both honor his oath and obey his superiors?


This is hardly first time in our history that patriotic soldiers have faced such a dilemma. In 1776 George Washington had to decide which he loved more: his homeland and his ancient liberties as an Englishman on the one hand, or his duty to his sovereign on the other. If events had gone differently at Yorktown, he would have been hanged for his treason to the Crown. During those same years many other principled men made the opposite choice and remained loyal to the king. As a result our young nation was riven by deep internal conflicts for decades afterwards.

Or consider Thomas Jonathan “Stonewall” Jackson, who in 1861 had to choose between loyalty to his homeland — the Sovereign Commonwealth of Virginia — and loyalty to a federal government that had ceased to respect the sovereignty of his State. He chose the former. Like many others at the time, his choice divided his family, since his sister was a staunch Unionist. Ironically, the county where he was born and grew up ceased to be part of Virginia during the war, opting instead to secede and join the new state of West Virginia.

Another such hinge of history seems to be at hand. Difficult times lie ahead.
If some form of economic collapse occurs — which hardly seems avoidable at this point — serving members of the military may be called upon to quell the resulting civil unrest. How can a soldier honor his oath when ordered to fire upon his fellow citizens?

Our public institutions have been so corrupted and degraded that we can hardly depend on them to make the right decisions about the constitutionality of such actions. Over the past twenty or thirty years all three institutional guardians — the Executive, the Congress, and the Supreme Court — have displayed a blatant disregard for the clear requirements of the United States Constitution.

An honorable soldier will simply have to follow his own conscience to make the choices necessary to fulfill his oath.

I wouldn’t want to be in his shoes when the time comes. God help us all.
