The Lawsuit that Could Overturn ObamaCare

When Missouri voters attempted to stop ObamaCare at the ballot box via the initiative process, the national news media took notice. In the August 3 vote, 7 in 10 voters in the “Show Me State” supported Proposition C, which overturns government mandates requiring health insurance. Proposition C actually bars penalties against people who pay their own health bills without insurance.

On August 2, U.S. District Judge Henry E. Hudson ruled against a U.S. Justice Department request to throw out a lawsuit brought by Virginia against ObamaCare. Virginia is arguing in the lawsuit that the U.S. Congress had unconstitutionally exceeded its powers by forcing individuals to buy insurance.

Hudson wrote, “While this case raises a host of complex constitutional issues, all seem to distill to the single question of whether or not Congress has the power to regulate — and tax — a citizen’s decision not to participate in interstate commerce…”

Hudson continues by saying there is, “some authority arguably supporting the theory underlying each side’s position.” Hudson’s decision sets up the opportunity to have appellate and eventually the Supreme Court decide these issues.

But our personal favorite of the many lawsuits challenging ObamaCare is from Arizona. Yes, the land of immigration enforcement could also be the site of a major constitutional battle about ObamaCare. The citizens of Arizona are restless with their Washington, D.C. overseers.

The Goldwater Institute, a public policy outfit named for Arizona’s most famous son, is taking a different swing at the question.

Representing a local business owner, Nick Coons of Tempe, Ariz., the Goldwater Institute has built an intriguing legal strategy which will shake up the debate: “Mr. Coons pays for all of his medical care out of his own pocket and he wants to continue making his own health care decisions. Under the federal health care bill, Mr. Coons will face significant fines from the IRS if he doesn’t buy a health insurance plan that has been approved by the government by 2014.”

In announcing the lawsuit Coons complained, “The government is making me spend money on something that I don’t want. Is a stranger who works for the government in some other part of the country really going to know what I need? I am the best qualified to make these decisions for myself.”

The Goldwater Institute’s lawyer is well-known constitutional litigator Clint Bolick. Bolick argues, “The new federal law also violates Mr. Coons’ medical privacy by forcing him to disclose his medical records to an insurance company, and those records could be accessed by the federal government and others without his permission.”

We have always been disturbed by the arrogance of government officials that seem to believe they have a right to know the most intimate details of your discussions with your doctor. ObamaCare will violate the sanctity and privacy of the relationship you have with your physician.

The framers of the U.S. Constitution would be shocked by the manipulation we have recently experienced at the hands of Congress, Obama, and out-of-control federal judges. Virginia Attorney General Ken Cuccinelli sums it all up when he said of ObamaCare’s attempts to regulate the behavior of doing nothing: “Even the king and the parliament acknowledged they didn’t have this power back before the Declaration of Independence.”

Judicial Watch: Find out exactly what these Czars are up to

Czars. The word reminds me of pre-communist Russia Tsars. So should we be concerned that comrade Obama has appointed 39 Czars? Absolutely, as outlined in this article from Jim Kouri. One only has to be reminded about the Marxist pig, Van Jones who Obama appointed, was forced to step down after he was exposed for what he is; an America hating Marxist. I hope Judicial Watch is successful in exposing many of  these Czars for what they are. No POTUS has abused this privelege like Obama. We should not be surprised. He does not give a rip about following the Constitution. By the way,  Judicial Watch is an excellent site.



'Czar' Investigations Recommended by Legal Group

Examiner, Article II section 2 of the U.S. Constitution states that:

"The President shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law."

However, President Barack Obama has been taking advantage of a recent precedent by appointing government officials who are not subject to Senate approval, according to non-partisan, public-interest group Judicial Watch.

These "czars" have tremendous power to regulate and control enormous parts of the American economy and government. And, as powerful as these czars are, some of them may not have even been subjected to a basic FBI background check.

This has allowed Obama to appoint several people with radical left-wing views, including one who supported the "9/11 truthers" movement (which believes the Bush administration may have been behind the 9/11 terror attacks on America) and another who called for "white people" to be removed from powerful positions in the media to make way for "people of color" and gays and voiced support for virulently anti-American Venezuelan dictator Hugo Chavez.

These czars have responsibilities that include managing America's Middle Eastern policy, "diversity," the auto industry, science, so-called climate change, "safe schools," health care and even the dispersal of funds from the Troubled Asset Relief Program (TARP).

Judicial Watch is concerned that some of these czar appointments raise significant constitutional questions. Our goal is to find out exactly what these czars are up to, what their missions are, and how much taxpayer money and government personnel they have at their disposal.

Last Month, Judicial Watch, announced today that it has filed a Freedom of Information Act (FOIA) lawsuit against the Obama Treasury Department to obtain documents regarding meetings involving Kenneth Feinberg, special master for executive compensation under the Troubled Asset Relief Program (TARP); AIG Chairman Robert Benmosche; and New York Federal Reserve Bank President William Dudley.

Feinberg, also known as the Obama administration's "pay czar," is the federal official responsible for setting compensation guidelines for the seven largest firms, including AIG, using funds from TARP.

In that effort, Judicial Watch has filed Freedom of Information Act (FOIA) and document requests for all 39 of the czars that Obama has appointed so far. Several of these investigations have already resulted in lawsuits due to the Obama Administration's stonewalling with regard to the release of relevant documents. Judicial Watch has also been key in publicizing the connections some of Obama's czars have had to radical, racist and even communist organizations.

Here is some background on Jim Kouri: Jim Kouri, CPP is currently fifth vice-president of the National Association of Chiefs of Police and he's a columnist for The Examiner (examiner.com) and New Media Alliance (thenma.org).
